The following General Terms and Conditions, in addition to the respective written offer from Schloss Hofen Wissenschafts- und Weiterbildungs-GmbH, govern the contractual relationship for the use of Schloss Hofen as a seminar hotel.
I. Contractual Agreements
We submit an individual written offer. Your booking is binding, and the contract is thereby concluded.
II. Services
Our services, as specified in the offer, include the provision of seminar rooms with technical infrastructure, catering, and accommodation/overnight stays at the seminar hotel, for the agreed dates with the stated prices and payment conditions.
III. Seminar Rooms
The seminar rooms are provided by us in accordance with the written offer and equipped with technical infrastructure. Their use is exclusively reserved for the contracting party, and only for the agreed time and purpose. The transfer of seminar rooms to third parties is only permitted with our express written consent. The agreed price includes ordinary contractual use and cleaning, provided that the cleaning does not exceed the usual extent. You are liable for any additional soiling or damage.
IV. Catering Services
Catering is provided exclusively by us, and bringing your own food and beverages is not permitted.
V. Accommodation / Overnight Stay
The rooms are also intended solely for the personal use of event participants. Transferring rooms to other persons is not permitted.
The contracting party is also liable for improper handling or damage to the rooms and their furnishings.
VI. House Rules
By booking, you confirm adherence to the house rules and the transmission of this obligation to all participants of your event. Pets are generally not allowed.
VII. Security
You must obtain and comply with all official permits and requirements associated with your event. Furthermore, building and fire safety regulations and directives, as well as fire protection provisions, must be observed.
VIII. Disclaimer of Liability
Should public law regulations exist that make our services according to point II impossible or restrict them in the form intended at the time of booking (e.g., due to epidemics), we reserve the right to cancel the booking or to modify the booked services accordingly. Should this be the case for your booking, you will be notified in a timely and appropriate manner. In any case, no claims for compensation for incurred expenses or other claims against Schloss Hofen can be derived therefrom, to the extent legally permissible.
Generally, we are only liable for intent or gross negligence and not in the event of theft, loss, or damage to items brought in, especially not for valuables.
IX. Advertising
Any form of advertising within the premises of Schloss Hofen and on the surrounding grounds is prohibited or requires our special consent. You may not use our company, our firm, or the Schloss Hofen brand for your own advertising purposes.
X. Data Protection / Confidentiality
By booking, you consent to the automated processing of your data and the data of the participants. Personal data will be stored electronically in compliance with applicable data protection regulations and treated confidentially. The data will not be passed on to third parties.
XI. Cancellation Policy
Cancellations must be made in writing. The following deadlines are deemed met if the cancellation is sent within the period:
Cancellations are free of charge up to 25 days before the start. In the case of cancellations after this period, a lump-sum compensation, not subject to judicial moderation, is to be paid as a cancellation fee: 25% of the total price within 25 days before the start of the event, 50% within 14 days, and 100% within 7 days.
XII. Applicable Law / Jurisdiction
Austrian law is agreed to be applicable. The contracting parties are aware that the concluded contract does not fall within the scope of the Tenancy Law Act. The exclusive place of jurisdiction for all disputes arising from contracts concluded between Schloss Hofen Wissenschafts- und Weiterbildungs-GmbH and its contracting parties is the court in Bregenz with subject-matter jurisdiction.
