We process personal data (hereinafter mostly referred to simply as “data”) only to the extent necessary and for the purpose of providing a functional and user-friendly website, including its content and the services offered there.

Pursuant to Art. 4(1) of Regulation (EU) 2016/679, i.e. the General Data Protection Regulation (hereinafter referred to as the “GDPR”), “processing” means any operation or set of operations performed on personal data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.

With the following privacy policy, we inform you in particular about the nature, scope, purpose, duration and legal basis of the processing of personal data, insofar as we decide either alone or jointly with others on the purposes and means of processing. In addition, we inform you below about the third-party components we use for optimisation purposes and to increase the quality of use, insofar as third parties process data under their own responsibility as a result.

Our privacy policy is structured as follows:

I. Information about us as the controller
II. Rights of users and data subjects
III. Information on data processing

I. Information about us as the controller

The controller of this website within the meaning of data protection law is:

Schloss Hofen – Wissenschafts- und Weiterbildungsges.m.b.H.
Hofer Straße 26
6911 Lochau
Austria
Data protection coordination contact: datenschutz@schlosshofen.at

II. Rights of users and data subjects

With regard to the data processing described in more detail below, users and data subjects have the right

In addition, the provider is obliged to inform all recipients to whom data has been disclosed by the provider of any rectification or erasure of data or restriction of processing carried out pursuant to Articles 16, 17(1), 18 GDPR. However, this obligation does not apply insofar as such notification is impossible or involves a disproportionate effort. Notwithstanding this, the user has a right to information about these recipients.

Users and data subjects also have the right, pursuant to Art. 21 GDPR, to object to the future processing of data concerning them, provided that the data is processed by the provider in accordance with Art. 6(1)(f) GDPR. In particular, an objection to data processing for the purpose of direct marketing is permissible.

III. Information on data processing

Your data processed when using our website will be deleted or blocked as soon as the purpose for storing it no longer applies, provided that no statutory retention obligations prevent deletion and no different information is provided below for individual processing procedures.

Cookie Manager

To obtain consent for the use of technically non-essential cookies on the website, the provider uses a cookie manager.

When the website is accessed, a cookie containing the settings information is stored on the user’s device so that the consent query does not have to be made again on a subsequent visit.

The cookie is required to obtain legally compliant consent from the user.

The user can prevent or stop the installation of cookies by adjusting their browser settings.

Cookies

a) Session cookies

We use so-called cookies on our website. Cookies are small text files or other storage technologies that are placed and stored on your device by the internet browser you use. These cookies process certain information about you to an individual extent, such as your browser or location data or your IP address.

This processing makes our website more user-friendly, effective and secure, as it enables, for example, our website to be displayed in different languages or a shopping cart function to be offered.

The legal basis for this processing is Art. 6(1)(b) GDPR, insofar as these cookies process data for the initiation or performance of a contract.

If the processing does not serve the initiation or performance of a contract, our legitimate interest lies in improving the functionality of our website. The legal basis is then Art. 6(1)(f) GDPR.

These session cookies are deleted when you close your internet browser.

b) Third-party cookies

Where applicable, our website may also use cookies from partner companies with whom we work for the purposes of advertising, analysis or the functionalities of our website.

Please refer to the information below for details, in particular regarding the purposes and legal bases for the processing of such third-party cookies.

c) Option to remove

You can prevent or restrict the installation of cookies by adjusting your internet browser settings. You can also delete cookies that have already been stored at any time. However, the steps and measures required for this depend on the specific internet browser you use. If you have any questions, please use the help function or documentation of your internet browser or contact its manufacturer or support. In the case of so-called Flash cookies, however, processing cannot be prevented via the browser settings. Instead, you must change the setting of your Flash player. The steps and measures required for this also depend on the specific Flash player you use. If you have any questions, please also use the help function or documentation of your Flash player or contact the manufacturer or user support.

However, if you prevent or restrict the installation of cookies, this may mean that not all functions of our website can be used to their full extent.

Contact requests / contact option

If you contact us via contact form or email, the data you provide will be used to process your request. Providing the data is necessary to process and respond to your request – without it, we cannot respond to your request, or only to a limited extent.

The legal basis for this processing is Art. 6(1)(b) GDPR.

Your data will be deleted once your request has been conclusively answered and no statutory retention obligations prevent deletion, e.g. in the case of any subsequent contract processing.

Newsletter

If you sign up for our free newsletter, the data requested for this purpose, i.e. your email address and – optionally – your name and address, will be transmitted to us. At the same time, we store the IP address of the internet connection from which you access our website as well as the date and time of your registration. As part of the further registration process, we will obtain your consent to receive the newsletter, describe the content in detail and refer you to this privacy policy. We use the data collected exclusively for sending the newsletter – in particular, it is not passed on to third parties.

The legal basis is Art. 6(1)(a) GDPR.

You can revoke your consent to receive the newsletter at any time with effect for the future in accordance with Art. 7(3) GDPR. To do so, you simply need to inform us of your revocation or click the unsubscribe link included in every newsletter.

Online job applications / publication of job advertisements

We offer you the opportunity to apply to us via our website. In the case of these digital applications, your applicant and application data is collected and processed electronically by us for the purpose of handling the application process.

The legal basis for this processing is Section 26(1) sentence 1 BDSG in conjunction with Art. 88(1) GDPR.

If an employment contract is concluded after the application process, we store the data you submitted with your application in your personnel file for the purpose of the usual organisational and administrative process – naturally in compliance with further legal obligations.

The legal basis for this processing is also Section 26(1) sentence 1 BDSG in conjunction with Art. 88(1) GDPR.

If an application is rejected, we automatically delete the data transmitted to us two months after notification of the rejection. However, deletion does not take place if the data requires longer storage of up to four months or until the conclusion of court proceedings due to statutory provisions, e.g. due to evidentiary obligations under the AGG.

In this case, the legal basis is Art. 6(1)(f) GDPR and Section 24(1) no. 2 BDSG. Our legitimate interest lies in legal defence and/or enforcement.

If you expressly consent to longer storage of your data, e.g. for inclusion in an applicant or interested-party database, the data will be further processed on the basis of your consent. The legal basis is then Art. 6(1)(a) GDPR. You can, of course, revoke your consent at any time with effect for the future by notifying us in accordance with Art. 7(3) GDPR.

Server data

For technical reasons, in particular to ensure a secure and stable website, data is transmitted by your internet browser to us or to our web hosting provider. These so-called server log files collect, among other things, the type and version of your internet browser, the operating system, the website from which you switched to our website (referrer URL), the website(s) of our website that you visit, the date and time of the respective access, and the IP address of the internet connection from which our website is used.

The data collected in this way is stored temporarily, but not together with other data about you.

This storage is based on Art. 6(1)(f) GDPR. Our legitimate interest lies in improving the stability, functionality and security of our website.

The data will be deleted no later than seven days thereafter, unless further retention for evidentiary purposes is required. Otherwise, the data is exempt from deletion in whole or in part until an incident has been finally clarified.

Facebook

To promote our products and services and to communicate with interested parties or customers, we maintain a company presence on the Facebook platform.

On this social media platform, we are jointly responsible with Meta Platforms Ireland Limited, 4 Grand Canal Square, Dublin 2, Ireland.

Facebook’s data protection officer can be reached via a contact form:

https://www.facebook.com/help/contact/540977946302970

We have regulated joint responsibility in an agreement regarding the respective obligations within the meaning of the GDPR. This agreement, which sets out the mutual obligations, can be accessed via the following link:

https://www.facebook.com/legal/terms/page_controller_addendum

The legal basis for the processing of personal data carried out in this way and described below is Art. 6(1)(f) GDPR. Our legitimate interest lies in analysis, communication, and the sale and promotion of our products and services.

The legal basis may also be the user’s consent pursuant to Art. 6(1)(a) GDPR vis-à-vis the platform operator. The user can revoke this consent at any time for the future by notifying the platform operator in accordance with Art. 7(3) GDPR.

When accessing our online presence on the Facebook platform, user data (e.g. personal information, IP address, etc.) is processed by Meta Platforms Ireland Limited as the operator of the platform in the EU.

Meta Platforms Ireland Limited uses this data for market research and advertising purposes as well as for creating user profiles. Based on these profiles, Meta Platforms Ireland Limited is able, for example, to display interest-based advertising to users within and outside of Facebook. If the user is logged into their Facebook account at the time of access, Meta Platforms Ireland Limited can also link the data to the respective user account.

If the user contacts us via Facebook, the personal data entered by the user on that occasion will be used to process the enquiry. The user’s data will be deleted by us once the user’s enquiry has been conclusively answered and no statutory retention obligations, e.g. in the case of subsequent contract processing, prevent deletion.

Meta Platforms Ireland Limited may also set cookies for data processing.

If the user does not agree with this processing, it is possible to prevent the installation of cookies by adjusting the browser settings accordingly. Cookies that have already been stored can also be deleted at any time. The settings for this depend on the respective browser. In the case of Flash cookies, processing cannot be prevented via the browser settings, but by adjusting the Flash player settings accordingly. If the user prevents or restricts the installation of cookies, this may mean that not all functions of Facebook can be used to their full extent.

Further information on the processing activities, how to prevent them and the deletion of data processed by Facebook can be found in Facebook’s data policy:

https://www.facebook.com/privacy/explanation

It cannot be ruled out that processing by Meta Platforms Ireland Limited also takes place via Meta Platforms, Inc., 1601 Willow Road, Menlo Park, California 94025, USA.

LinkedIn is a service of LinkedIn Ireland Unlimited Company, Wilton Plaza, Wilton Place, Dublin 2, Ireland, a subsidiary of LinkedIn Corporation, 1000 W. Maude Avenue, Sunnyvale, CA 94085, USA.

In this respect, we would like to point out that there is a possibility that user data may be processed outside the European Union, in particular in the USA. This may result in increased risks for users insofar as, for example, later access to user data may be made more difficult. We also have no access to this user data. Access is exclusively held by LinkedIn.

General linking to profiles with third-party providers

The provider uses links on the website to the social networks listed below.

The legal basis is Art. 6(1)(f) GDPR. The provider’s legitimate interest lies in improving the quality of use of the website.

The plugins are integrated via a linked graphic. Only by clicking on the respective graphic is the user redirected to the service of the respective social network.

After the customer is redirected, information about the user is collected by the respective network. This initially includes data such as IP address, date, time and the page visited. If the user is logged into their user account of the respective network at that time, the network operator may be able to assign the collected information about the user’s specific visit to the user’s personal account. If the user interacts via a “Share” button of the respective network, this information can be stored in the user’s personal user account and possibly published. If the user wants to prevent the collected information from being directly assigned to their user account, they must log out before clicking on the graphic. In addition, it is possible to configure the respective user account accordingly.

The following social networks are linked by the provider:

Facebook Pixel conversion tracking

We use the Facebook visitor action pixel on our website, a web analytics and conversion measurement service provided by Meta Platforms Ireland Limited, 4 Grand Canal Square, Dublin 2, Ireland, a subsidiary of Meta Platforms Inc., 1601 S. California Ave., Palo Alto, CA 94304, USA, hereinafter “Facebook”.

The Facebook visitor action pixel helps us analyse user behaviour on our website and promote our services on the Facebook platform. The basis for this is Art. 6(1)(a) GDPR. The user can revoke their consent to use it at any time for the future in accordance with Art. 7(3) GDPR via the settings of the consent manager (“Cookie settings”) on our website.

The visitor action pixel establishes a connection to Facebook’s servers in the USA. Facebook records the IP address and information about the user’s browser. In addition, an individual pixel ID is stored along with the user’s associated website activities.

Meta Platforms Inc. is part of the “Data Privacy Framework”, for which the EU Commission has issued an adequacy decision pursuant to Art. 45 GDPR:

https://www.dataprivacyframework.gov/list

Thanks to this data processing, Facebook can show the user personalised advertising from us on Facebook or on third-party sites. Conversion measurement also enables us to analyse and evaluate user behaviour after clicking on a Facebook advertisement and subsequently being redirected to our website, in order to increase the effectiveness of our Facebook advertisements.

In this context, we are jointly responsible with Meta Platforms Ireland Limited, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland, within the meaning of Art. 26 GDPR.

The jointly responsible parties have set out their respective obligations under the GDPR in an agreement. This agreement can be viewed via the following link:

Google Analytics

We use Google Analytics on our website, a web analytics service provided by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland, a subsidiary of Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA, hereinafter “Google”.

Google Analytics helps us analyse the use of the website and measure the effectiveness of our marketing campaigns. The legal basis is Art. 6(1)(a) GDPR. The user can revoke their consent to the use of Google Analytics at any time for the future in accordance with Art. 7(3) GDPR via the “Cookie settings” on our website.

Information such as time, location and frequency of website visits as well as interactions with the website (e.g. click paths, ads viewed/clicked, clicks on links), including the user’s IP address, is transmitted to a Google server in the USA and stored there for a maximum of 2 months.

Google LLC is part of the “Data Privacy Framework”, for which the EU Commission has issued an adequacy decision pursuant to Art. 45 GDPR:

https://www.dataprivacyframework.gov/list

Google also collects “demographic characteristics” and can create statistics that allow conclusions to be drawn about the age, gender and interests of website visitors. This is done through the automated analysis of advertising and information from third-party providers.

If the user has enabled personalised ads in their Google account and consents to Google Analytics, Google can analyse usage behaviour across devices – i.e. in relation to all devices that the user has linked to their Google account. Google creates models for cross-device conversions; only anonymous statistics are transmitted to us, not personal data.

If the user wishes to disable this cross-device analysis, they can switch off the “Personalised advertising” function in their Google account settings via the following link:

https://support.google.com/ads/answer/2662922?hl=de

We use Google Analytics with an anonymisation function. This means that the user’s IP address is shortened by Google within EU Member States or in other contracting states of the EEA Agreement.

Google uses the data collected to evaluate the user’s visit to the website and to compile reports for us on website activity. The data is also used to provide further services related to website and internet usage. Google may pass this information on to third parties where required by law or where third parties process this data on Google’s behalf.

According to its own information, Google will not link the user’s IP address with other Google data under any circumstances. Google provides further information and options for preventing data use here:

https://www.google.com/intl/de/policies/privacy/partners

If the user does not agree with the collection, they can also prevent it by installing the browser add-on to deactivate Google Analytics once.

Google Tag Manager

We use Google Tag Manager to integrate various functions on our website. This product is provided by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland, a subsidiary of Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA, hereinafter “Google”.

Google Tag Manager is used solely to integrate certain content into our website and to enable the management of these functions via an interface provided by Google.

When the website is accessed, the corresponding functions are loaded from a Google server, which may also be located in the USA. The user’s IP address is processed in order to provide the functions.

The functions used are listed exhaustively in our privacy policy. Any consents not granted by the user for certain functions are also observed when using Google Tag Manager.

Google LLC is also part of the “Data Privacy Framework”, for which the EU Commission has issued an adequacy decision pursuant to Art. 45 GDPR:

https://www.dataprivacyframework.gov/list

The legal basis for use is Art. 6(1)(f) GDPR. Our legitimate interest lies in optimising and operating our website economically.

Google Fonts

We use Google Fonts in our website to display external fonts. This is a service provided by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland, hereinafter referred to simply as “Google”.

To enable the display of certain fonts on our website, a connection to the Google server in the USA is established when our website is accessed.

The legal basis is Art. 6(1)(f) GDPR. Our legitimate interest lies in optimising and operating our website economically.

Through the connection established when our website is accessed, Google can determine from which website your request was sent and to which IP address the font display is to be transmitted.

Google provides

https://adssettings.google.com/authenticated

https://policies.google.com/privacy

further information, in particular on options for preventing data use.

Google reCAPTCHA

We use Google reCAPTCHA on our website to verify and prevent interactions on our website through automated access, e.g. by so-called bots. This is a service provided by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland, hereinafter referred to as “Google”.

Through this service, Google can determine from which website a request is sent and from which IP address you use the so-called reCAPTCHA input box. In addition to your IP address, Google may also collect other information that is necessary for providing and ensuring this service.

The legal basis is Art. 6(1)(f) GDPR. Our legitimate interest lies in the security of our website and in defending against unwanted automated access in the form of spam or similar.

Google provides

https://policies.google.com/privacy

further information on the general handling of your user data.

Google Maps

We use Google Maps on our website to display our location and to create directions. This is a service provided by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland, hereinafter referred to as “Google”.

If you access the Google Maps component integrated into our website, Google stores a cookie on your device via your internet browser. In order to display our location and create directions, your user settings and data are processed. In this context, we cannot rule out that Google uses servers in the USA.

If you have given your consent for this processing, the legal basis is Art. 6(1)(a) GDPR. The legal basis may also be Art. 6(1)(f) GDPR. Our legitimate interest lies in optimising the functionality of our website.

Through the connection established in this way, Google can determine from which website your request was sent and to which IP address the directions are to be transmitted.

If you do not agree with this processing, you have the option of preventing the installation of cookies by adjusting the settings in your internet browser accordingly. Details can be found above under “Cookies”.

In addition, the use of Google Maps and the information obtained via Google Maps is subject to the Google Terms of Service and the Google Maps Terms and Conditions.

Google also provides

https://adssettings.google.com/authenticated

https://policies.google.com/privacy

further information.

Google AdWords with conversion tracking

We use the Google AdWords advertising component on our website and, in doing so, so-called conversion tracking. This is a service provided by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland, hereinafter referred to as “Google”.

We use conversion tracking to promote our offering in a targeted manner. If you have given your consent for this processing, the legal basis is Art. 6(1)(a) GDPR. The legal basis may also be Art. 6(1)(f) GDPR. Our legitimate interest lies in the analysis, optimisation and economic operation of our website.

If you click on an ad placed by Google, the conversion tracking we use stores a cookie on your device. These so-called conversion cookies expire after 30 days and are not used to identify you personally.

If the cookie is still valid and you visit a specific page on our website, both we and Google can evaluate that you clicked on one of our ads placed on Google and were subsequently redirected to our website.

Google uses the information obtained in this way to create statistics for us about visits to our website. We also receive information about the number of users who clicked on our ad(s) and about the pages of our website that were subsequently accessed. However, neither we nor third parties that also use Google AdWords are thereby able to identify you in this way.

You can also prevent or restrict the installation of cookies by adjusting the settings of your internet browser. At the same time, you can delete cookies that have already been stored at any time. However, the steps and measures required for this depend on the specific internet browser you use. If you have any questions, please use the help function or documentation of your internet browser or contact its manufacturer or support.

Google also provides

https://services.google.com/sitestats/de.html

https://www.google.com/policies/technologies/ads/

http://www.google.de/policies/privacy/

further information on this topic, in particular on options for preventing data use.

Google Remarketing or “Similar Audiences” component from Google

We use the remarketing or “Similar Audiences” function on our website. This is a service provided by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland, hereinafter referred to as “Google”.

We use this function to place interest-based, personalised advertising on third-party websites that also participate in Google’s advertising network.

If you have given your consent for this processing, the legal basis is Art. 6 para. 1 lit. a GDPR. The legal basis can also be Art. 6 para. 1 lit. f GDPR. Our legitimate interest lies in the analysis, optimization, and economic operation of our website.

To enable this advertising service, Google stores a cookie with a sequence of numbers on your device via your internet browser during your visit to our website. This cookie records your visit and the use of our website in anonymized form. However, no personal data is passed on. If you subsequently visit a third-party website that also uses Google’s advertising network, advertisements may appear that relate to our website or our offers there.

For permanent deactivation of this function, Google offers a browser plugin for the most common internet browsers via

https://www.google.com/settings/ads/plugin

a browser plugin.

Likewise, the use of cookies from certain providers can be deactivated via, for example,

http://www.youronlinechoices.com/uk/your-ad-choices

or

http://www.networkadvertising.org/choices/

via opt-out.

Through so-called cross-device marketing, Google may, under certain circumstances, track your usage behavior across multiple devices, so that you may still be shown interest-based, personalized advertising even if you switch devices. However, this requires that you have consented to the linking of your browser histories with your existing Google account.

Google provides further information on Google Remarketing at
